Proposed insurance rule changes target public adjusters | Naked ...

Although lawmakers opted against doing major property insurance reform this year, critics say state agencies are pursuing controversial reforms outside of the legislative process.

According to Policyholders of Florida, the Department of Financial Services is seeking rule changes that would crack down on public adjusters.

?These careless changes muddle the line between right and wrong," said Sean Shaw, founder of Policyholders of Florida. "They should have been vetted by all of the stakeholders involved, not stealthily pushed through while no one is looking.?

A hearing on the rule changes is set to take place on Thursday.

Sneaky Rule Changes to Adjuster Laws Would Hurt Policyholders

?

Tampa, Fla? The?Policyholders of Florida?today called upon the Department of Financial Services to suspend proposed?rule changes?to Insurance Adjusters that would harm consumers.
?
These rule changes are being pursued?outside the light of the legislative process:


  • Eliminating the requirement for industryadjusters to ?act with dispatch and due diligence in achieving a proper disposition of the claim.??69B-220.201(3)(f)
  • Requiring?only?public adjusters, not all adjusters, to provide claim status to the insured within 30 days of a request.?69B-220.201 (4)(k)
  • Axing the requirement that adjusters provide insureds with accurate information about their rights and eliminating the requirement that adjusters take care to avoid engaging in the unlicensed practice of law.??69B-220.201(3)(m)?
?Any reputable insurance adjuster would agree that every measure should be taken to protect policyholders from unethical and dishonest practices. If adjusters aren?t working honestly and playing by the rules, than our entire insurance market is at risk,? said?Sean Shaw, founder of the Policyholders of Florida. ?These careless changes muddle the line between right and wrong.
